PLEASE REVIEW THESE OFFICIAL RULES (“OFFICIAL RULES”) BEFORE ENTERING THE STARTUP ARLINGTON CONTEST ("CONTEST"). BY ENTERING, THE ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES, INCLUIDNG ANY AMENDMENTS, AND BY THE DECISIONS OF THE CONTEST ADMINISTRATOR AND THE JUDGES, WHICH ARE FINAL.
ENTRY TO THE CONTEST IS FREE, AND NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN.
THE CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
The Arlington County Economic Development department (“Contest Administrator”) is administering the Startup Arlington contest to promote Arlington County’s technology- and start-up-friendly community.
A judging panel and voting members of the public will select one winner, who will be provided, at a minimum, with three months of free lodging and office workspace in Arlington County to enable the Contest winner to continue to develop his or her company.
The Contest sponsors, which will be providing prizes to the winner, are: (1) Kiddar Capital, 100 N Washington Street #224, Falls Church, VA 22046; (2) 1776 Startup Incubator, 2231 Crystal Drive #1000, Arlington, VA 22202; (3) Vornado Realty Trust (WhyHotel/The Bartlett), 520 12th St S, Arlington, VA 22202; (4) Crystal City Business Improvement District, 2001 Jefferson Davis Hwy, Arlington, VA 22202; and (5) Arlington Transportation Partners, 1501 Wilson Blvd #1100, Arlington, VA 22209.
Eligible Entrants must be either a founder or the chief executive officer of a technology-based company and must be (1) at least 21 years of age at time of entry and (2) able to reside in Arlington County, Virginia between April 1 and June 30, 2017. The Contest Administrator may verify each Entrant's eligibility to participate in the Contest.
Eligibility Exclusions: The Contest is not open to residents of Arlington County, Virginia; Fairfax County, Virginia; Loudoun County, Virginia; Prince William County, Virginia; Prince George’s County, Maryland; Montgomery County, Maryland; Howard County, Maryland or the District of Columbia. Also excluded from eligibility are: (1) contest judges and employees, officers, directors, agents and representatives of the Arlington County government and of the Contest sponsors and their parent, subsidiary and affiliate companies (“Excluded Individuals”); (2) Excluded Individuals’ parents, spouses, children, siblings, in-laws, grandparents and grandchildren and their respective spouses; and (3) any residents in an Excluded Individual’s household, whether legally related or not.
HOW TO ENTER
Entrants must complete the Contest application online at the Contest Site: http://www.arlingtoneconomicdevelopment.com/business-services/high-growth-ventures/startup-arlington
All entries must be submitted between January 5 and January 31, 2017, and must be written in English.
Each entrant who is chosen as a finalist will be required to submit a 90-second video that demonstrates why his or her company should be chosen as the winner including:
Finalists will be required to upload their videos for public viewing to a website hosted by Hootsuite (https://hootsuite.com/products/campaigns).
The Contest Administrator will notify finalists by e-mail by February 15, 2017.
CONDITIONS OF ENTRY
The Contest Administrator may disqualify entries that are not submitted in accordance with the instructions provided on the Contest Site and with these Official Rules and may disqualify any Entrant whom the Contest Administrator determines has breached these Official Rules.
Entrants must own or have permission to use any submitted trademarks, logos or other intellectual property; and the Contest Administrator may request proof of such ownership or permission.
By submitting an entry, an Entrant grants the Arlington County government and its affiliates, agents and licensees the right to reproduce, copy, store, transmit, publish, display, adapt and/or otherwise use the Entrant’s name, statements and biographical material, as well as any other materials arising out of the Entrant’s participation in the Contest (“Entrant Information”), in any manner or media without notice or compensation. The Entrant waives any rights that may preclude the Arlington County government from using or disclosing the Entrant Information and releases the Arlington County government from any claims arising out of any use or disclosure of the Entrant Information consistent with these Official Rules.
The use or publication of an Entrant's name or information in connection with the Contest does not signify that the Entrant is the Contest winner.
The Contest winner will be determined by a combination of judges’ scores and public voting, which the Contract Administrator will conduct via the online service Hootsuite.
The judges will be Contest Administrator representatives, who will score Entrants’ applications on a scale of 1-5 points – where 1 is strongly disagree, 2 is disagree, 3 is neutral, 4 is agree and 5 is strongly agree – as applied to the following statements:
In the event of a tie with respect to points, the judges will vote to determine the winner of the judges’ scoring, which will result in the selection of three finalists.
The public will be allowed to vote on the finalists’ videos on the Hootsuite site between February 21 and February 28, 2017. Each member of the public may vote once per day during the voting period.
The winner will be the finalist whose video receives the most votes from the public.
If the Contest winner is at any time found not to be eligible or not to be in compliance with these Official Rules, the winner will be disqualified, and the finalist who received the next highest number of public votes will be declared the winner, even if the disqualified winner's name or Entrant Information has already been shown or announced online. The disqualified winner will be required to forfeit any prizes that he or she has already received, as instructed by the Contest Administrator.
The Contest Winner will be notified by e-mail and telephone, and his or her name will be posted on the Contest site on or about March 1, 2017.
The Contest Winner will be issued a 1099 for the actual value of all prizes. The prizes are not transferable, assignable or redeemable for cash. The Contest winner is responsible for all tax liabilities and other costs associated with prize acceptance and use. The details of any prize awarded are at the awarding sponsor's and the Contest Administrator’s discretion; and complete terms and conditions of the prizes will be disclosed to the winner when the prizes are awarded.
LIMITATIONS OF LIABILITY
The Arlington County government and its officers, employees, agents and representatives (collectively "Released Parties") are not responsible for any incorrect or inaccurate entry of information, human error, technical malfunction, lost data, delayed data transmission, omission, interruption, deletion, defect, failure of any telephone, computer equipment, software or network, inability to access the Contest Site, inability to upload or download any Contest-related materials from or onto the Contest Site or late, lost, damaged, misdirected, delayed, garbled, incorrect, inaccurate, stolen, damaged or incomplete entries.
EXCEPT TO THE EXTENT THAT THE RELEASED PARTIES' NEGLIGENCE CAUSES ANY PERSONAL INJURY OR DEATH, THE RELEASED PARTIES SHALL NOT BE RESPONSIBLE FOR ANY CLAIMS, LOSSES, LIABILITY OR DAMAGES OF ANY KIND ARISING IN CONNECTION WITH THE ACCEPTANCE, USE OR MISUSE OF ANY ENTRY MATERIAL; AN ENTRANT’S PARTICPATION IN THE CONTEST OR IN ANY CONTEST-RELATED ACTIVITY; OR AN ENTRANT'S BREACH OF ANY AGREEMENT ASSOCIATED WITH THE CONTEST, INCLUDING THESE OFFICIAL CONTEST RULES.
Each Entrant bears liability for the contents of his or her entry and shall hold harmless and indemnify the Released Parties for any damages and costs that the Released Parties incur as a result of a third party’s claim or demand relating to the content of the Entrant’s entry or participation in the Contest.
Any attempt to damage the Contest website or to undermine the legitimate operation of the Contest will disqualify the actor from the Contest.
The Contest Administrator may cancel, modify or suspend the Contest as a result of a force majeure event or any other event beyond the Contest Administrator’s reasonable control. If such an event requires the Contest Administrator to shorten the application period, the Contest Administrator may determine the Contest winner from among all eligible entries received up to that time, using the judging process described above.
CHOICE OF LAW
This Contest and these Official Rules are governed by laws of the Commonwealth of Virginia, and any and all legal actions arising in connection with this Contest must be brought in a court of competent jurisdiction in Arlington County, Virginia, or in the Alexandria Division of United States District Court for the Eastern District of Virginia and in no other court.
